1. Why did I get a notice?

The Notice was issued to tell you about a class action lawsuit, Torres, et al. v. Prudential Financial, Inc. et al. brought against Prudential Financial, Inc., ActiveProspect, Inc., and Assurance IQ, LLC. This lawsuit is brought on behalf of people who, while in California, visited Prudential.com between November 23, 2021, and December 13, 2022, and provided personal information to receive a quote for life insurance. You got the notice because you may be a member of the group of people affected, called the “class.” The Notice gives you information about the case and tells you how to opt out if you don’t want to be part of it.

All natural persons who, while in California, visited Prudential.com, provided personal information on Prudential’s form to receive a quote for life insurance, and for whom a TrustedForm Certificate URL associated with that website visit was generated from November 23, 2021, to December 13, 2022.

5. Do I have a lawyer in this lawsuit?

In a class action, the court appoints class representatives and lawyers to work on the case and represent the interests of all the class members. For this case, the Court has appointed the following lawyers.

6. What is this lawsuit about?

Beginning in 2022, this class action lawsuit was filed against Prudential Financial, Inc. and ActiveProspect, Inc., and later, Assurance IQ, LLC. The lawsuit was brought on behalf of people who, while in California, visited Prudential.com and provided personal information on Prudential's form to receive a quote for life insurance. The lawsuit claims that ActiveProspect wiretapped website visitors' communications on Prudential's webform for life insurance, in violation of the California Invasion of Privacy Act. The lawsuit also claims that Prudential Financial and Assurance IQ aided and abetted ActiveProspect in this wiretapping.

ActiveProspect, Prudential, and Assurance IQ deny the claims in the lawsuit.

7. What Happens next in this lawsuit?

The parties will continue to pursue legal action and prepare the case for trial, unless the two sides decide to settle the case.

You have two options. You can do nothing and stay in the case, or you can opt out of the case.

9. What are the consequences of doing nothing?

If you do nothing, you will be part of the case and your rights will be affected by the outcome. You won’t be able to start, continue, or be part of any other lawsuit against Prudential Financial, Inc., ActiveProspect, Inc., or Assurance IQ, LLC about the issues in this case.

If the consumer Plaintiffs win or settle, class members may be entitled to money. If the Defendant companies win, class members will receive nothing.
